Welcome to Loyalti. These Terms of Service constitute a legally binding agreement between you and Gostar Service Inc., operator of the Loyalti platform. By creating an account or using our services, you agree to be bound by these terms.
We invite you to read them carefully. If you do not agree with these terms, please do not use Loyalti.
1. Acceptance of terms
By checking the "I accept the terms of service" box during registration, by clicking "Sign Up," or simply by using Loyalti, you acknowledge that you have read, understood, and accepted these terms as well as our privacy policy.
To use Loyalti, you must be at least 14 years old. If you are a minor, you confirm that you have the authorization of a parent or guardian.
2. Description of the service
Loyalti is a web and mobile platform that enables:
- Clients: to discover and book appointments at hair salons, barbershops, and beauty establishments, and to earn loyalty points
- Establishment owners: to manage their appointment schedule, team, loyalty program, and clients
- Specialists (employees): to manage their personal schedule and appointments
3. Account types
Client Account
Free. Allows you to book appointments, manage your preferences, and earn loyalty points at participating establishments.
Owner Account
Available in free or Pro plan. Allows you to create and manage an establishment, its team, its services, and its loyalty program. Reserved for individuals with legal authority to represent the establishment.
Specialist Account (Staff)
Created upon invitation from an owner. Gives you access to your personal schedule and appointments within the establishment that employs you.
4. Registration and account security
When creating your account, you agree to:
- Provide accurate, complete, and up-to-date information
- Maintain the confidentiality of your password
- Not share your account with others
- Notify us immediately of any unauthorized use of your account
- Be solely responsible for all activities performed through your account
We reserve the right to suspend or delete any account created with false information or used in violation of these terms.
5. Acceptable use
You agree to use Loyalti in a respectful manner and in compliance with the law. In particular, it is prohibited to:
- Create multiple accounts to circumvent limitations or restrictions
- Publish false, misleading, or defamatory reviews
- Book appointments without sincere intention to attend (systematic no-shows)
- Attempt to access accounts or our systems without authorization
- Use bots, scripts, or automated tools to extract data from or interact with the platform
- Upload illegal, offensive, defamatory, hateful, pornographic content or content that infringes on the rights of others
- Impersonate another person or entity
- Circumvent the technical protection measures of the platform
- Use the platform for commercial purposes other than those intended (resale, data aggregation, etc.)
6. Paid plans (Pro) and billing
Loyalti offers a paid Pro plan for establishment owners wishing to access advanced features.

- Automatic monthly billing via Stripe
- Automatic renewal unless cancelled
- Access to SMS notifications for you and your team
- Advanced analytics features

Payment terms
Payments are processed by Stripe Inc., a PCI-DSS Level 1 certified payment provider. Loyalti never has access to your full card number.
The price is expressed in Canadian dollars (CAD) and does not include applicable taxes (GST/QST for Quebec residents), which will be added to the invoice where applicable.
By subscribing to the Pro plan, you authorize Gostar Service Inc. to automatically charge your payment method each month until you cancel your subscription.
Cancellation
Refund policy
An exception may be made in case of demonstrable billing error on our part. For any dispute, contact us at jrdivers@gostarservice.com within 30 days of the transaction.
Price changes
We reserve the right to modify the prices of paid plans. Any price change will be communicated to you by email at least 30 days before it takes effect. You will then be able to cancel your subscription if you do not accept the new price.
Payment failures
If a payment fails, we will attempt to process it again for a period of 7 days. After that period, your subscription will be automatically downgraded to the free plan, and certain Pro features may be deactivated. Your data remains intact.
7. User content (reviews, photos)
Loyalti allows you to publish content, including reviews and comments about establishments. By submitting this content, you:
- Confirm that you are the original author or have the right to publish it
- Grant us a non-exclusive, worldwide, free, and transferable license to host, display, reproduce, and adapt this content on Loyalti
- Warrant that the content is accurate, based on real experience and in good faith
- Accept that we may moderate or delete content that violates these terms
You can modify your reviews for 30 days after publication. After that period, they become permanent (except upon justified deletion request).
8. Intellectual property
The Loyalti platform, its name, logo, design, code, texts, graphics, and any other component are the exclusive property of Gostar Service Inc. or its licensors, and are protected by Canadian and international laws on copyright, trademarks, and intellectual property.
Nothing in these terms grants you any rights to these elements, except the limited, non-exclusive, and revocable right to use Loyalti in accordance with these terms.
9. Privacy
The processing of your personal information is governed by our Privacy Policy, accessible at /privacy. By accepting these terms, you also acknowledge having read and accepted this policy.
10. Limitation of liability
To the extent permitted by law, Gostar Service Inc. cannot be held liable for:
- The services rendered (or not rendered) by establishments or specialists you meet through Loyalti
- The quality, safety, legality, or compliance of these services
- Disputes between clients and establishments
- Indirect, incidental, special, or consequential losses arising from the use of Loyalti
- Service interruptions, data losses, or delays due to causes beyond our control (technical issues, third-party providers, force majeure events)
Our total liability to you, whatever the cause, shall in no case exceed the amount you have paid us during the 12 months preceding the incident, or 100 CAD if you have not paid.
Nothing in this section limits your liability in case of intentional violation or gross negligence of applicable law, nor does it attempt to exclude or limit non-waivable rights you may have as a consumer under the Quebec Consumer Protection Act.
11. Indemnification
You agree to indemnify and hold Gostar Service Inc., its officers, employees, and partners harmless from any claim, damage, loss, or expense (including reasonable attorney fees) arising from:
- Your violation of these terms
- Your violation of law or the rights of a third party
- Content you publish on Loyalti
- Your abusive or fraudulent use of the platform
12. Changes to the service and terms
We may modify, suspend, or discontinue all or part of Loyalti at any time, with or without notice.
We may also modify these terms of service. In case of substantial change, we will notify you by email at least 30 days before they take effect. Your continued use of Loyalti after the new terms take effect constitutes acceptance.
If you do not accept the new terms, you can close your account before they take effect.
13. Suspension and termination
By you
You can delete your account at any time from your profile or by contacting us. Deletion results in the definitive loss of your data (except those we must retain for legal obligations).
By us
We may suspend or terminate your account if:
- You violate these terms or our acceptable use policy
- You use Loyalti fraudulently, abusively, or illegally
- You fail to pay your paid subscriptions after reasonable payment attempts
- A competent authority orders us to do so
- We decide to close Loyalti (with reasonable notice)
14. Governing law and jurisdiction
These terms are governed by the laws in force in the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute relating to these terms or your use of Loyalti will be submitted to the exclusive jurisdiction of the courts of the Longueuil judicial district, in the Province of Quebec, Canada.
In accordance with the Quebec Consumer Protection Act, nothing in this clause deprives you of the right to bring an action before the courts of the district where you reside.
15. Miscellaneous provisions
Entire agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Gostar Service Inc. regarding Loyalti.
Severability
If any provision of these terms is held invalid or unenforceable by a competent court, the remaining provisions shall remain in full force.
No waiver
Our failure to exercise or enforce any provision of these terms does not constitute a waiver of that provision.
Assignment
You may not assign your rights or obligations under these terms without our written agreement. We may freely assign our rights and obligations to any subsidiary, successor, or acquirer.
